Terms and Conditions

Below you will find the rules of cooperation, service execution, payments, and the rights and obligations of the parties.

1. General provisions

These Terms and Conditions define the rules for the provision of services by MediaDev STUDIO via the website mediadev.studio, as well as through email or telephone communication. The Terms apply to cooperation with consumers and business clients, unless otherwise stated in a given case.

2. Definitions

The terms used in these Terms shall mean:

  • Service Provider - MediaDev STUDIO
  • Client - a natural person, legal entity, or organizational unit using the services
  • Agreement - an agreement for the provision of services concluded remotely or in documentary form (e.g. e-mail)
  • Project - the result of creative or technical work, including in particular: a website, visual identity, graphic materials, print materials, content, or social media management

3. Scope of services

MediaDev STUDIO provides in particular the following services:

  • design and implementation of websites and landing pages
  • branding and visual identity (logo, brand book, key visual)
  • design of advertising materials for print and digital use (e.g. flyers, business cards, posters, banners)
  • preparation of print-ready files in accordance with technical specifications
  • mediation in the execution of printing services by external partner print houses
  • management and operation of social media profiles (content, graphics, publications)

Printing services are carried out by external printing companies. MediaDev STUDIO is not a printing house and does not perform printing services on its own.

4. Conclusion of the agreement and rules of cooperation

The agreement is concluded after determining the scope of work, the completion deadline, and the remuneration. Arrangements may be made via email, telephone, or a contact form. Commencement of service execution may require:

  • acceptance of the offer or quotation
  • payment of an advance or the full amount - if agreed
  • provision of materials necessary for project execution

5. Remuneration and payments

The remuneration is determined individually in the offer or agreement. The Client is obliged to make payments on time. Depending on the nature of the project, the following may apply:

  • advance payment
  • advance payment and final payment
  • milestone-based settlement

Failure to make payment on time may result in suspension of work.

6. Client obligations

The Client is obliged to cooperate with the Service Provider, in particular to:

  • provide materials (texts, images, logos, access to tools) within the agreed timeframe
  • provide information, feedback, and approval of work stages within a reasonable time

The Client is responsible for the accuracy and legality of the materials provided.

7. Revisions and changes

Within the agreed price, the Client is entitled to the number of revision rounds specified in the offer or agreement. Unless otherwise agreed, this usually includes:

  • 2 rounds of revisions per project stage

Changes exceeding the agreed scope may be subject to additional pricing.

8. Completion deadlines and delivery

Completion deadlines are indicative unless otherwise agreed. The deadline is calculated from the moment the conditions for commencing work are met. Delivery of work results takes place in electronic form.

9. Printing and production of materials

In the case of printing services, MediaDev STUDIO acts as an intermediary between the Client and an external printing company. Printing is carried out by third parties in accordance with their own regulations, technology, and production specifications.

MediaDev STUDIO may offer the Client more favorable printing prices resulting from discounts or cooperation terms with partner printing houses.

Responsibility for print quality, print run accuracy, color consistency, and any physical defects of the product lies with the printing company fulfilling the order, unless the defect results directly from errors in file preparation by MediaDev STUDIO.

The Client is obliged to approve graphic designs and production files before they are sent for printing. Approval constitutes confirmation of the correctness of content, layout, color scheme, and technical parameters.

10. Copyright and license

Copyright to the projects is transferred to the Client or a license is granted - in accordance with the arrangements specified in the offer or agreement - after full payment of the remuneration. Until payment is made, the Service Provider retains the rights to the project.

The Client declares that they hold the rights to the materials provided to the Service Provider.

11. Liability

The Service Provider is liable only to the extent provided for by applicable law. The Service Provider shall not be liable for:

  • content and materials provided by the Client
  • color differences resulting from printing technology or monitor settings
  • printing errors resulting from files approved by the Client
  • delays or errors on the part of external printing companies
  • operation of external tools or services (e.g. hosting, social media platforms)

12. Complaints

Complaints regarding services provided by MediaDev STUDIO should be submitted to the following e-mail address: kontakt@mediadev.studio. Complaints regarding print quality are subject to the complaint procedures of the printing company fulfilling the order. MediaDev STUDIO may act as an intermediary in the complaint process but does not guarantee a positive outcome.

13. Right of withdrawal (consumers)

If the Client is a consumer, they have the right to withdraw from a distance contract within 14 days, subject to exceptions provided by law, in particular in cases where service provision has commenced with the Client’s consent.

14. Final provisions

In matters not regulated by these Terms, the provisions of Polish law shall apply. MediaDev STUDIO reserves the right to introduce changes to these Terms for important reasons. The current version of the Terms is available on the website.
